West Virginia Attorney General Patrick Morrisey has subpoenaed drug company Mylan N.V. in an investigation over drastic price hikes for its EpiPen.
Morrisey announced Tuesday that he filed a Kanawha County Circuit Court petition to force Mylan to produce documents from a subpoena from several weeks ago.
Morrisey's office is seeking evidence of possible state antitrust and Medicaid rebate violations through the subpoena.
The allergy pen prices have grown to $608 for a two-pack, an increase of more than 500 per cent since 2007. The company has announced it will launch a generic version that costs $300.
Mylan CEO Heather Bresch and a Food and Drug Administration official will testify before the U.S. House Oversight and Government Reform Committee on Wednesday.
Bresch is the daughter of Democratic U.S. Sen. Joe Manchin of West Virginia.
