BC Court Upholds Seabridge Gold’s KSM Start Status but Orders Further Indigenous Consultation

On June 8, 2026, the Supreme Court of British Columbia ruled that the provincial Environmental Assessment Office’s 2024 finding that Seabridge Gold’s KSM project was substantially started was reasonable. However, the Court held that regulators had not adequately consulted the Tsetsaut Skii km Lax Ha and ordered a 90-day window for the group to make submissions before the determination is reconsidered.
A separate petition from SkeenaWild Conservation Trust was dismissed, allowing Seabridge to continue work at KSM during the new consultation and review process. The company’s chair and CEO said permanent physical improvements at KSM have been significantly enhanced, with total expenditures on permanent works reaching about $1.2 billion since applying for substantially started status in January 2024, underscoring KSM’s strategic importance to Seabridge and its regional partners.
