The latest announcement is out from TotalEnergies SE ( (FR:TTE) ).
TotalEnergies has decided to appeal a June 25, 2026 judgment by the Paris Judicial Court in a climate-related case brought under France’s duty of vigilance law. The decision follows board deliberations and centers on how far the law extends corporate responsibility for climate change.
The company argues that climate change, as a global phenomenon, falls primarily under the responsibility of states rather than the scope of the duty of vigilance statute. It also contends the law is intended to cover risks from a firm’s own operations, subsidiaries and suppliers, not customers’ use of its products.
TotalEnergies warns that requiring energy, defense, aeronautics or automotive groups to control risks arising from product use would conflict with legal certainty and freedom to conduct business. It notes that the new European Corporate Sustainability Due Diligence Directive similarly does not include customers’ activities in its remit.
By pressing these arguments before the Paris Court of Appeal, TotalEnergies is seeking to narrow the legal boundaries of corporate climate liability. The case could influence how duty of vigilance and EU due diligence rules are interpreted for large industrial and energy companies, with implications for compliance burdens and stakeholder expectations.
