The Supreme Court of Canada has rejected a claim by survivors of a Protestant orphanage in Prince Edward Island who sought damages for what they say were years of abuse in the institution.

The high court has upheld an appeal ruling which found the provincial government had no duty of care because it was a privately run orphanage.

The appeal judges said the government had no duty of care to children placed in the long-defunct orphanage by family members, guardians and charities.

The Supreme Court agrees in a 9-0 ruling.

The appeal judges did say the province had a responsibility for any provincial wards sent to the orphanage, which shut down in 1976.
