A New Brunswick judge ordered a Miramichi woman to produce records showing how often she uses Facebook in her lawsuit over a car crash. The record from her Internet service provider would demonstrate whether the woman could return to work as a hospital clerk, the judge ruled.

A British Columbia Supreme Court judge orders the production of records showing how often a plaintiff alleging a brain injury uses Facebook.

In Leduc v. Roman , Mr. Justice David Brown of the Ontario Superior Court ruled that a defendant in a car-crash personal injury case had the right to cross-examine the plaintiff on the contents of his Facebook page.

He ruled the page was likely relevant to the case: "To permit a party claiming very substantial damages for loss of enjoyment of life to hide behind self-set privacy controls on a website, the primary purpose of which is to enable people to share information about how they lead their social lives, risks depriving the opposite party of access to material that may be relevant to ensuring a fair trial."
