On December 31, 2022, Ardagh Metal Packaging USA Corp. sued Boston Beer in the U.S. District Court for the Northern District of Illinois, alleging the brewer failed to meet contractual minimum purchase volumes for certain aluminum beverage cans between 2021 and 2025. On April 6, 2026, a jury returned a verdict in Ardagh’s favor, awarding approximately $175.5 million in damages after offsetting Boston Beer’s counterclaim, with judgment still pending and post-trial motions yet to be filed.
Boston Beer, which continues to deny breaching the contract, plans to pursue post-trial and appellate remedies but expects to record a one-time pre-tax litigation expense of about $175.5 million plus any accrued interest in its upcoming first-quarter 2026 results due April 30. The company said it intends to fund any required payment from its $223.4 million cash balance as of December 27, 2025 and an undrawn $150 million credit line, does not expect a material impact on operating plans, and still plans to maintain its up-to-$25 million share repurchase program running from March 30 to June 26, 2026.
